Service Purchase and Sale Agreement
All in-game materials such as items, skins, characters, gold bars (game currency), etc. shall hereinafter be referred to in this Agreement as In-Game Services.
Parties
1) Market: The market located at the domain www.bynogame.com, which facilitates intermediary services for in-game services and materials such as items, skins, characters, gold bars (in-game currency), etc., by establishing a bridge between the Buyer and the Seller, shall hereinafter be referred to as the Market in this Agreement.
2) Seller: Any third party individual(s) who create(s) promotional pages by listing and providing information and visuals related to In-Game Services such as items, characters, gold bars (game currency), etc. on the Market, and offers such to their/our customers, shall hereinafter be referred to as the Seller.
3) Buyer: Any individual(s) who shall receive or take delivery of In-Game Services such as items, characters, gold bars (game currency), etc. from the Market shall hereinafter be referred to as the Buyer.
SELLER:
1) The SELLER acknowledges, declares, and undertakes that if the IN-GAME SERVICE listed as an advertisement by the SELLER is sold, the BUYER has 12 hours to receive the delivery; that after 12 hours, the SELLER has the right to cancel the transaction; and that the transaction will be automatically approved after 24 hours.
2) The SELLER acknowledges, declares, and undertakes that the IN-GAME SERVICE they have listed belongs to the correct server in that category, that the information provided in the listing description and comments is entirely accurate, that the features of the IN-GAME SERVICE are identical to those shown in the photo they have uploaded to our system, and that all features mentioned in the description are fully included.
3) The SELLER acknowledges, declares, and undertakes that once they have listed the IN-GAME SERVICE they wish to sell on the MARKET, the connection and responsibility between the MARKET and the SELLER begins. The SELLER further affirms that, during the time period from listing the IN-GAME SERVICE to the moment of its sale, they have not used a Proxy for logging into the MARKET site, they have not logged in from any address other than the one they provided to the MARKET site, they have not shared their membership login details with anyone, the security of their account is their sole responsibility, and that the character they used to deliver the IN-GAME SERVICE in the game complies with these rules.
4) 1. The SELLER must be registered in the ByNoGame MARKET system with a valid and verified mobile phone number and must hold the status of a Verified Member in order to create listings for IN-GAME SERVICES.
2. Following the placement of an order by the BUYER, the SELLER is obligated to deliver the relevant in-game item (such as a skin, item, etc.) to the BUYER via a trade through the Steam platform. If the trade offer is withdrawn before the expiration of the 7-day protection period, the BUYER may have the right to submit a claim under the ByNoGame Buyer Protection.
3. After the SELLER has completed the trade transaction, the payment made by the BUYER shall remain blocked in the ByNoGame Secure Pool for the duration of the 7 (seven) days Steam Trade Protection Period. If the item is not reversed during this period, the sales amount shall be automatically transferred to the SELLER’s ByNoGame Wallet on the day following the expiration of the 7-day Steam Trade Protection Period.
4. The SELLER agrees not to withdraw or modify the in-game item (skin, item, etc.) delivered until the expiration of the 7 (seven) day Steam Trade Protection Period. Any conduct in breach of this obligation shall constitute a violation of the ByNoGame Seller Policies and may result in the restriction or termination of the account.
5. Under this provision, the SELLER’s obligations shall be deemed fulfilled upon the full completion of the trade transaction and the successful completion of the 7-day period in accordance with Steam’s policies regarding the delivered item.
5) The SELLER is prohibited from making any changes to the price, server, or content of a listing that has been sold and is awaiting delivery. Therefore, any incorrectly stated prices, incorrect listing descriptions, and server changes are entirely the responsibility of the SELLER, and they are required to deliver the IN-GAME SERVICE as specified in the listing, including the price and features. Otherwise, the SELLER will be subject to an indefinite ban from listing on the MARKET.
6) If the SELLER loses the IN-GAME SERVICE or has it stolen for reasons beyond their control, they must remove the listing from the MARKET before it is sold. Listings for IN-GAME SERVICES that are no longer in the SELLER’s possession will be considered failed deliveries, and the SELLER will receive a negative rating. These negative ratings will affect the SELLER's delivery success rate, and sellers with low success rates will be indefinitely banned from the MARKET.
7) The SELLER acknowledges, declares, and undertakes that they must log in to the MARKET site at least once every 7 days to confirm that the information regarding the IN-GAME SERVICE is up to date, regardless of whether they receive a warning from the MARKET. Otherwise, their item will be removed from the site without inquiry or question.
8) The SELLER acknowledges, declares, and undertakes that they will be directly responsible for all situations where the IN-GAME SERVICE is found to be stolen or illegal, such as being reclaimed by game administrators or having the user's character banned, for a period of 30 days after the sale of the IN-GAME SERVICE. The SELLER agrees to compensate for all material and moral damages. The SELLER also acknowledges that all personal information provided to the MARKET site may be shared with judicial authorities to expedite the legal process, and they consent to this.
9) The SELLER acknowledges, declares, and undertakes that 100% of the revenue generated from the sale of the IN-GAME SERVICES added to the MARKET will be transferred to the MARKET accounts. After the commission fee determined by the site based on the item price is deducted (with the commission percentages being 20%, 15%, 12%, or 10%), the remaining amount will be transferred to the SELLER's bank account after the EFT transaction fee is deducted. The MARKET reserves the right to change the commission rate without notifying the other parties mentioned in this agreement.
10) The SELLER acknowledges, declares, and undertakes that, for security and necessary inspections, their money may be held in the MARKET accounts for up to 72 hours. The SELLER is also obligated to promptly provide documents requested by the MARKET, such as a copy of their ID, proof of residence, a document proving ownership of a fixed phone, mobile phone, etc.
11) The SELLER acknowledges, declares, and undertakes that, in the event of any issues related to the in-game service they have posted, such as being unreachable via phone or email, not keeping the site listing updated with changes in the in-game service listing, failing to update the listing when banned, incorrect server, incorrect in-game service, incorrect description, and incorrect images, they are fully responsible for all such situations. As a result, the SELLER's rating (category/class) may be downgraded by the MARKET, all old and new listings may be considered insecure, and in necessary situations, the MARKET may block the SELLER from posting new listings for one month or indefinitely.
12) The SELLER acknowledges, declares, and undertakes that they can never log into the system using another user's account (such as a friend or partner). In this case, both individuals will be jointly responsible for any resulting damages, and both individuals agree, declare, and undertake this responsibility.
13) Due to occasional disruptions in the game, GM (Game Master) may apply a rollback process to revert the game to a previous time. In this case, if the SELLER has sold and received payment for an IN-GAME SERVICE at a specific date and time, and the game is rolled back, the GAME MASTER may return the service to the SELLER's (SELLER character's) account involuntarily. If the SELLER does not return the IN-GAME SERVICE to MARKET in this situation, they will be legally prosecuted for fraud. In such disputes, the Courts of Izmir are authorized on behalf of MARKET.
14) The SELLER accepts, declares, and undertakes that they are fully responsible for the deletion of the item they have entrusted, the potential duplication (dupe) or theft (stolen) of the item, the rollback, or the banning of the character they have entrusted.
15) The SELLER accepts, declares, and undertakes that they are obliged to retrieve the item they have entrusted if, for any reason, the item cannot be delivered to the BUYER by the MARKET. The SELLER is responsible for any inconvenience that may arise from not retrieving the item.
a) The SELLER is obliged to show their ID on screen via a LIVE VIDEO CONNECTION if requested, to prove that they possess the correct identity.
b) The SELLER is obliged not to recover their Google, Google+, Gmail accounts by corresponding with Google for any reason. If they do, they are required to pay a compensation of $5000 (Five Thousand US Dollars).
c) The SELLER is obliged to sign this contract with a wet signature and send it to the MARKET via postal mail if requested.
d) The MARKET may request the original of the SELLER's residence address by mail or cargo in necessary situations; the SELLER is obliged to send it. The SELLER is responsible for providing this.
16)
a) The SELLER agrees, declares, and undertakes that the Ring left for sale on the MARKET complies exactly with the features described in the advertisement. When the BUYER receives the Ring, they will have 15 minutes to inspect it. If the BUYER does not approve within this time frame and indicates an issue with the character or reports that they have received a different product than described, the cost of breaking the Ring will be borne by the SELLER. Items left for trash collection are not subject to charging; if you are selling an item with a character, you can first deliver the items to us and then turn the character into a Ring and deliver it in a second transaction. In USKO servers, the BUYER and SELLER cannot hold the MARKET responsible for quest items that cannot be obtained from trash. Even if ads claiming to contain items from trash are approved, the company is not responsible if no items are found. Additionally, the transaction will be marked as 'Cancelled by SELLER' and a negative point will be assigned to the SELLER.
b) The BUYER accepts that the history of the Ring they have purchased is unknown and cannot hold the MARKET responsible for any situation that may occur to the Ring.
17) The SELLER acknowledges that when adding in-game service photos to the site, the MARKET may host these images on a different domain or server. The SELLER's responsibility for the accuracy of the photo and all contractual obligations will be exactly the same as if they were uploaded to the MARKET server.
18) 1. When a sale is completed through a listing related to CS2 skins, the SELLER shall be informed through a system-generated SMS notification and/or via MARKET live support. The SELLER agrees to carry out the trade via Steam within the designated delivery period after the BUYER completes the payment and undertakes to fully complete all necessary steps required for the successful completion of the transaction.
2. A 7 (seven) day Steam Trade Protection Period shall apply to such transactions. During this period, the amount paid by the BUYER shall be held within the ByNoGame Secure Pool. If the item is not reversed during this time, the sales amount shall be automatically transferred to the SELLER’s ByNoGame Wallet on the day following the expiration of the 7-day Steam Trade Protection Period.
3. MARKET (ByNoGame.com) shall not, under any circumstances, be held liable for any losses incurred by the SELLER arising from fake SMS notifications, fraudulent bots, or any deceptive content generated by third parties during the delivery process. The SELLER expressly acknowledges, declares, and agrees to rely solely on official communications received via the MARKET live support channel, and accepts that in-game messages, forum posts, social media communications, or any other means shall not be deemed official communication channels of the MARKET.
19) The SELLER, by using the ByRobot Escrow service for VGO Skin/KEY listings on the site with automatic publishing and delivery, is considered to have accepted its terms. In the event of any negative situations such as bans, account clearances, bugs, etc., in the ByRobot inventory where the VGO Skin/Key is deposited, ByNoGame is not responsible, and the SELLER cannot hold ByNoGame liable for the fate of the skins delivered. In case of a ban, bug, or account clearance, ByNoGame is not obligated to compensate for any damages. The SELLER, by accepting this rule, acknowledges and agrees that they have delivered their Skin/Key.
20) The SELLER cannot artificially increase the Steam market value of the product they wish to sell by making several buy-sell transactions above its actual value. In such attempts to manipulate the Steam market value, all responsibility lies with the SELLER, and ByNoGame cannot be held responsible for any damages. Furthermore, the SELLER acknowledges, declares, and undertakes that the value of the in-game service they have added is correct, and they are fully responsible for any communication related to incorrect value after the BUYER has received the product.
BUYER
1) From the moment the in-game service is received by the BUYER, the responsibility lies with them. In cases of ban, hack, or deletion, the BUYER cannot hold MARKET responsible.
2) Upon the BUYER's purchase of the in-game service, MARKET will attempt to contact the SELLER. The BUYER cannot cancel or change the product before 1 hour has passed from the time of contacting the SELLER. After 1 hour, the BUYER has the right to cancel or wait for up to 24 hours.
3) After purchasing an IN-GAME SERVICE, the BUYER may only exercise their right to request a return or cancellation within the 7 (seven) days Buyer Protection period provided by ByNoGame, following the delivery of the relevant digital product by the SELLER through the ByNoGame system.
If, during this period, the product has been duly delivered by the SELLER and no objection has been raised by the BUYER:
The BUYER’s right of withdrawal or cancellation shall expire.
The transaction shall be deemed completed upon the expiration of the 7 + 1 day protection period.
The sales proceeds shall be transferred to the SELLER’s ByNoGame Wallet.
If the BUYER wishes to report an issue concerning the SELLER within the specified delivery period, they must submit a request via the "Apply for ByNoGame Buyer Protection" option available on the order details page.
In accordance with this clause, after the delivery of digital products, the BUYER may not arbitrarily refuse receipt of the product, disrupt the process, or request the cancellation of the transaction without valid grounds. In the absence of any objection within the specified period, the sale shall be considered finalized and the payment transaction executed.
4) In the event that the in-game service is not delivered within the promised 60-minute period, the BUYER must immediately make a cancellation decision and notify the SELLER before the service is delivered. After the service is delivered by the SELLER, the in-game service cannot be canceled or refunded.
5) The BUYER is responsible for the accuracy of the in-game service purchased. The BUYER makes the purchase decision by reviewing the details of the in-game service listed on the MARKET. By completing the order in multiple steps, if the BUYER purchases an incorrect product, they waive their right to dispute this error.
6) The BUYER may receive any ID from the MARKET's current character with the name provided by MARKET, through trade with the MARKET carrier character. The in-game service will not be delivered until the BUYER confirms it with live support if they want to transfer it to their own character. After this confirmation, even if the BUYER says, "I did not receive the in-game service" or "The in-game service I received was not this one," the in-game service will be considered the BUYER's responsibility, and it cannot be returned to MARKET.
7) The BUYER acknowledges, declares, and undertakes that they shall never log in to the system using any account other than their own (such as a friend's or partner’s account), and both individuals involved shall be jointly responsible for any resulting damages or grievances.
8) Occasionally, due to technical issues in the game, Game Masters (GMs) may implement a rollback, reverting the game to a previous state. In such cases, an in-game service that the BUYER has purchased from us at any given date and for which payment has been received may be involuntarily restored to the SELLER’s (SELLER character’s) account by game administrators. The BUYER is required to wait for the SELLER to re-deliver the in-game service to the MARKET. The BUYER shall not file any claims for compensation against the MARKET in relation to this matter. If the SELLER fails to take initiative, the MARKET reserves the right to pursue legal remedies on behalf of both itself and the BUYER. For such disputes, the courts of İzmir shall have exclusive jurisdiction on behalf of the MARKET.
9) It is solely the BUYER’s responsibility to verify the in-game value of a skin/item. The BUYER acknowledges, declares, and undertakes that they shall not hold the MARKET liable for any errors concerning the market value of the purchased skin, that they were aware of the market value prior to the purchase, and that the SELLER listed the item at a price of their own choosing.
MARKET
1) In the event of any disputes arising from non-compliance with the above terms, the Courts of İzmir shall have exclusive jurisdiction on behalf of the MARKET.
2) The MARKET reserves the right to cancel or refund in exceptional or extraordinary circumstances.
3) If a product is listed with an incorrect price, ByNoGame® reserves the right to refrain from selling said product or to make changes to the product and/or any of its components.
